1. Statement of intent
TRM Flex Limited operates a software platform for the events, venues and hospitality sector. We take health and safety seriously, both within our own operations and in how the platform supports clients to plan and deliver safe events. This Statement is published with reference to the Health and Safety at Work etc. Act 1974 (“HSWA 1974”) and the Management of Health and Safety at Work Regulations 1999.
2. Important: who is the duty-holder for an event
TRM Flex is a software provider. We do not employ the workforce that delivers events through the platform; workers engaged via the marketplace are self-employed contractors with their own statutory and contractual responsibilities. We do not assume the duties of an event organiser, principal contractor, employer, venue operator or occupier.
In any given event, the legal duty-holders for health and safety are typically the event organiser (our client), the venue operator and any third-party suppliers contracted by the organiser. TRM Flex's role is to provide tooling that helps those duty-holders coordinate safely; it does not transfer or discharge their duties under HSWA 1974.
3. Our own responsibilities (as a business)
Within TRM Flex Limited's own operations — primarily a remote software business — we will, so far as is reasonably practicable:
- provide a safe working environment for any employees and visitors;
- assess risks arising from our activities and act on them;
- provide adequate information, instruction and supervision to staff;
- ensure equipment we provide is safe and properly maintained;
- review this Statement and our risk assessments at least annually and after any incident.
4. Client (event organiser) responsibilities
When using the platform to plan or deliver an event, the client retains all duties as event organiser, including:
- completing event-specific risk assessments and recording suitable controls;
- complying with venue licensing conditions and local authority requirements;
- holding appropriate insurance, including public liability cover;
- complying with the Regulatory Reform (Fire Safety) Order 2005;
- complying with the Licensing Act 2003 where regulated activities take place;
- ensuring food safety where food is served (Food Safety Act 1990 and related regulations);
- safeguarding any children or vulnerable adults attending or working at the event;
- reporting reportable injuries, diseases and dangerous occurrences under RIDDOR 2013.
5. Self-employed contractor responsibilities
Workers engaged through the platform are self-employed and responsible for:
- taking reasonable care of their own and others' health and safety (HSWA 1974 s.7);
- cooperating with the event organiser's health and safety arrangements;
- holding any qualifications, certifications or PPE required by the engagement;
- arranging their own appropriate insurance where required by the engagement;
- reporting hazards, near-misses and incidents promptly to the event organiser and, where appropriate, to TRM Flex.
Nothing in this Statement creates an employment relationship between TRM Flex and any self-employed contractor. TRM Flex does not operate PAYE for, or deduct National Insurance from, contractors engaged via the platform.
6. Reporting incidents
Incidents that occur at an event must be reported by the event organiser in line with their own health and safety arrangements and, where applicable, to the Health and Safety Executive under RIDDOR 2013 (hse.gov.uk/riddor). Where an incident relates to use of the platform itself, please notify us at hello@trmflex.com with subject prefix [Incident].
7. Insurance
TRM Flex Limited maintains business insurance appropriate to its activities as a software provider. The platform does not provide insurance cover for clients, suppliers, contractors, attendees or events; those parties must arrange their own appropriate cover.
8. Review
This Statement is reviewed at least every 12 months and after any material change.
